Account Terms of Use & Privacy Policy

By creating an account on the Nomad Trailer Rentals Booqable store page (“Platform”), you agree to these Account Terms of Use and our Privacy Policy. If you do not agree, you may not create or maintain an account.

Part I — Account Terms of Use

1. Eligibility

• You must be at least 18 years old and legally able to enter into binding contracts under Alabama law.
• Accounts may only be created with accurate and complete personal and contact information.

2. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account login credentials.
• You are responsible for all activities under your account, whether authorized by you or not.
• Notify us immediately of any unauthorized access or security concerns.

3. Accuracy of Information

• You agree to provide truthful, current, and complete information when creating an account and when making reservations.
• False or misleading information may result in account suspension or termination.

4. Reservations & Rentals

• An account is required to reserve trailers.
• All reservations, deposits, payments, and rental obligations are governed by the Nomad Trailer Rentals Rental Agreement, which is incorporated by reference into these Terms.
• If there is a conflict between these Terms and the Rental Agreement, the Rental Agreement will control.

5. Payments & Deposits

• By creating an account, you authorize us to securely store payment details for the purpose of processing deposits, rental fees, late fees, or damage charges in accordance with the Rental Agreement.
• You must ensure your payment method remains valid and up to date.

6. Prohibited Uses

You agree not to:

• Use your account for fraudulent activity or misrepresent your identity.
• Attempt to damage, disable, or misuse our Platform or equipment.
• Violate any applicable federal, state, or local laws.

7. Suspension & Termination

• We may suspend or terminate your account at any time, without notice, for violating these Terms or the Rental Agreement.
• You may request account deletion at any time by contacting us.

8. Limitation of Liability

• We are not responsible for damages resulting from unauthorized account access, user error, or third-party misuse of your information, except as required by Alabama law.
• To the fullest extent permitted by law, our liability will not exceed the amount you paid for the reservation giving rise to the claim.

9. Governing Law

These Terms are governed by the laws of the State of Alabama. Any disputes shall be resolved in the courts of Tuscaloosa County, Alabama.

10. Changes to These Terms

We may update these Terms at any time. Updates will be posted on our Platform with a revised effective date. Continued use of your account after changes are posted constitutes acceptance of the revised Terms.

Part II — Privacy Policy

1. Information We Collect

We may collect any information necessary to provide, manage, and protect our services, including but not limited to:

• Personal details (name, address, phone number, email).
• Identification information (driver’s license, state-issued ID, Social Security number, or other identifiers).
• Payment and billing details (processed and stored securely by our payment processor).
• Insurance details, emergency contacts, or employment information when required.
• Rental history, account activity, and communications with us.
• Any other information you provide voluntarily or that we are legally required to collect.

• Process reservations, deposits, payments, and fees.
• Verify your identity and rental eligibility.
• Communicate with you regarding rentals, cancellations, or support.

We do not sell or trade your personal information. We may share your data with:

• Payment processors to complete transactions securely.
• Insurance providers if you opt for coverage or in the event of a claim.
• Law enforcement, courts, or regulatory bodies when legally required or in connection with fraud, theft, or damage investigations.

4. Data Security

• We implement reasonable safeguards to protect your information.
• However, no system is completely secure. You acknowledge that providing information online involves some risk.

5. Data Retention

• We retain records for as long as necessary to comply with legal, tax, insurance, and business requirements under Alabama law.
• Payment information is stored securely by our third-party processor, not directly by Nomad Trailer Rentals.
